“Common mistakes committed while submitting Form No: 10D for claiming EPS,’95 Pension “either upto Ceiling or on Full Wages (Higher Pension)”

Date of Birth: 01-07-1957
Date of Appointment
as Casual Driver Gr-II: 11-08-1992
Date of Removal
due to involment
in accident: 21-06-1994
Reinstated by Labour
Court without
back Wages: 10-07-1998
Date of attaining 58
years: 30-06-2015
Pensionable Salary: 7,725/-
Wages as on 15-11-1995
(though the employee was not
in service as on 15-11-1995
Wages as on the date of removal
as Casual Driver should be mentioned)
Reasons:
Other than removal, he may be in
long sick while in service as on
15-11-1995 i.e., as example from
01-01-1995 to 31-12-1995. Or in case
other Establishments just like
Jute Mill, may be in Lock-out for
the above period of 01-01-1995
31-12-1995. Simply because the
employee is not on duty as on
15-11-1995 due to various reasons
the Column (Wages on 15-11-1995
should not be left behind, but should
be filled with Wages as on the date
prior to 15-11-1995. In the case of the
above employee i.e., Sri B.M. Reddy,
Wages as on the date of removal
i.e., 21-06-1994 should be mentioned.

Treatment of “Removal period”
21-06-1994 to 09-07-1998
i) 21-06-1994 to 15-11-1995
(Period under EFPS,’71)
should be ignored.
ii) 16-11-1995 to 09-07-1998
i.e., 964 days should be shown
as NCP days inaddition to
actual NCP days from the date of
reinstatement to date of attaining
58 years i.e., 38 days=1,002 days.

Due to showing Date of reinstatement
by Labour Court as Date of Appointment
i.e., 10-07-1998
instead of showing Date of Appointment as
Casual Driver i.e., 11-08-1992
the above Employees lost
Past Service Benefit of
359/- (80X4.485)
and
Two years Weightage:
6,500/70X2=186/-
(EPS,’95 Service taken only
from 10-07-1998 to 30-06-2015
i.e., 16 years, 11 months and 15 days
instead of from 11-08-1992 to 30-06-2015
22 years, 10 months and 22 days

Total loss to the Employee:
Past Service Benefit: 359/-+
Two years Weightage: 186/-=
545/-
Loss from July, 2015 to June, 2025:
545X12X10=65,400/-
With Interest as per the rates
declared by EPFO from year to
year: more than 1,00,000/-

Now the Employee is eligible for
Higher Pension and the loss may
go more than 1,000/- per month i.e.,
1,20,000/- in arrears from July, 2015
June, 2015:
1,000X12X10=1,20,000/-

There may be number of similar cases in
both APSRTC?TSRTC.
